To enable appointments to Committees and Outside Bodies to be considered. |
2.0 BACKGROUND
2.1 At the Annual General Meeting of the Council on 18 May 2022, appointments to committees and Major Outside Bodies were made. Since that time, a number of changes have been proposed, as detailed in this report.
2.2 The new North Yorkshire Council will have responsibilities for the administration of planning and licensing. As such, appointments need to be made to the committees that have been proposed in the draft Constitution for the new North Yorkshire Council. Appointments are being sought at the February 2023 meeting of the Council, as opposed to the May Annual General Meeting, as it is anticipated that the planning and licensing committees will have to meet in April and May. It is also the case that planning decisions may need to be made at the Yorkshire Dales National Park Authority and the North York Moors National Park Authority in April and May and so appointments are also being made to those authorities.
2.3 The nominations that have been received are specified in Appendix 1.
3.0 STRATEGIC PLANNING COMMITTEE
3.1 The Strategic Planning Committee will have responsibility for significant planning applications relating to minerals or waste and planning applications for more than 500 houses. The Executive recommended that the membership of the committee would be 12 councillors. A committee size of 15 has also been included in the list of nominations, as there has been some debate regarding the committee size.
3.2 The allocation of seats on the committee was calculated based upon the political proportionality for the Council as a whole.
3.3 Council will need to appoint a Chair and Vice Chair for this committee.
4.0 AREA CONSTITUENCY PLANNING COMMITTEES
4.1 The Area Constituency Planning Committees. The membership of the Area Constituency Planning Committees is 7 councillors.
4.2 The allocation of seats on the committees was calculated based upon the political proportionality for the Area Constituency Committee.
4.3 Council will need to appoint a Chairs and Vice Chairs for each of these committees.
5.0 GENERAL LICENSING AND REGISTRATION COMMITTEE
5.1 The General Licensing and Registration Committee comprises 25 councillors Of the 25 councillors, 15 will comprise the membership of the Statutory Licensing Committee. Only Members who have received licensing training can sit on the Committee.
5.2 The allocation of seats on the committee was calculated based upon the political proportionality for the Council as a whole.
5.3 Council will need to appoint a Chair and Vice Chair for this committee.
6.0 STATUTORY LICENSING COMMITTEE
6.1 The Statutory Licensing Committee comprises 15 councillors. The Statutory Licensing Committee and its Sub-Committees are not required to be politically proportionate by virtue of the Licensing Act 2003. Only Members who have received licensing training can sit on the Committee.
6.2 There are three Statutory Licensing Sub-Committees. Each Sub-Committee shall comprise three councillors drawn down from the full Statutory Licensing Committee.
6.3 Council will need to appoint a Chair and Vice Chair for this committee.
7.0 NORTH YORK MOORS NATIONAL PARK AUTHORITY
7.1 The Council nominates 9 councillors to the North York Moors National Park Authority. The nominations are calculated based upon the political proportionality for the Council as a whole.
8.0 YORKSHIRE DALES NATIONAL PARK AUTHORITY
8.1 The Council nominates 10 councillors to the Yorkshire Dales National Park Authority. The nominations are calculated based upon the political proportionality for the Council as a whole.
9.0 APPOINTMENTS TO OTHER COMMITTEES
9.1 The Transition (LGR) Overview and Scrutiny Committee currently does not have a Vice Chair. A Vice Chair was not appointed when the committee was established, as it was envisaged that the committee would end as of 31 March 2023. It is now proposed that this committee continues into the new North Yorkshire Council and so it is appropriate that a Vice Chair is nominated. The Vice Chairs for overview and scrutiny committees are usually appointed from the opposition groups.
9.2 The Conservative Group to make the following changes to the memberships of the Care and Independence Overview and Scrutiny Committee:
· County Councillors Andrew Lee and Angus Thompson to come off the committee
· County Councillors George Jabbour and Andy Paraskos to go onto the committee.
9.3 David Houlgate is currently a Scheme Member Representative on the Pension Board. His appointment is coming to an end and so the members of the Pension Board are seeking his reappointment for a further 4 year period.

RECOMMENDATION
That County Council:
a) approves the appointments to the Planning and Licensing Committees as specified in Appendix 1. In doing so, the necessary appointments to for Chairs and Vice Chairs are made b) approves the appointments to the Yorkshire Dales National Park Authority and the North York Moors National Park Authority as specified in Appendix 1 c) approves the appointment of a Vice Chair to the Transition (LGR) Overview and Scrutiny Committee d) approves the appointments to the Care and Independence Overview and Scrutiny Committee e) approves the appointment to the Pension Board f) considers any other appointments raised by Group Secretaries. |
